Definitions

MSB means Makeabl Sdn Bhd.

SERVICES means MSB's video and photograph capture and distribution services and related products, which are offered through SnaptureX platform.

VISITOR means a visitor to events using SnaptureX services

CUSTOMER means a Visitor who uses and access our services whether on-line, in-person at on-site service kiosks

SERVICE CHANNELS means the method of access to our services, including but not limited to on-line websites or ticketing sites, in-person at on-site service kiosks or via the Makeabl photomobile application.

Introduction

1. You are deemed to accept the terms and conditions set out here in the event you choose to proceed to use or access our Services via any of the Service Channels. These terms and conditions should be read in conjunction with any terms of sale for specific purchases made by you and our Privacy Policy.

2. Please take careful note of these terms and conditions - you should not proceed to use or access the Services if you object to any of these terms and conditions.

3. By using or accessing any our Services, you represent and warrant that you are aged 18 years old or above; are competent to contract; and agree to be bound by these terms and conditions. Visitors or Customers under the age of 18 must use and access our services through their parent or guardian or responsible adult's consent on their behalf.

Personal data and privacy

4. By using SnaptureX and any of our Service Channels, Visitors consent to the collection and use of their personal data, in accordance with the terms herein and our Privacy Policy found at https://snapturex.makeabl.io (to be read in conjunction with MSB's terms of use and private data protection policy).

5. Our collection and use of your personal data shall include the collection and use of your image by various means including via ride-capture or slow-motion cameras, static cameras, by designated photographers and at photo kiosks sites during your event.

Service availability

6. We strive to ensure that our Services are available at all times, but we do not guarantee uninterrupted access. Services may be temporarily unavailable due to maintenance, technical issues, or other circumstances beyond our control.

7. We reserve the right to modify, suspend, or discontinue any part of our Services at any time without prior notice.

Intellectual property

8. All content, including but not limited to photographs, videos, logos, and text, available through our Services is the property of MSB or its licensors and is protected by copyright and other intellectual property laws.

9. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.

Limitation of liability

10. To the maximum extent permitted by law, MSB shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services.

11. Our total liability for any claims arising from or related to our Services shall not exceed the amount you paid for the specific service in question.
